Potosí activates a second trial of René Joaquino


La Paz - Bolivia, November 22, 2010

The Potosi District Attorney activated a new trial against ex-mayor sentenced Joaquino René Cabrera, where the judge set for Dec. 1 hearing to support the order concluding the case called "illegal appointments."
The second charge against the leader of the Social Alliance (AS) is for alleged illegal appointments he made while serving as mayor of Potosi from 2007 to 2009, positions which are defined and penalized under Article 157 of the Penal Code.
That article states that "shall be punished by a fine of 30 to 100 days, the official who appoints or intends to three candidates for public office who does not satisfy the legal conditions for their performance."
District Attorney Potosi, Sandro Strong, said that if the judge allows the prosecution with the evidence and if there any comments, regardless of prosecution, the trial court may set date, day and time for a new trial against Joaquino.
According to the rules to hold office in the institution without the national title to practice fits the crime of illegal appointments. Two other people also are accused of the illegal practice of the profession by petition from Mr. Genaro Hidalgo.
On Wednesday, Joaquin and six of his former council members were sentenced to three years imprisonment in the first instance, on charges of dereliction of duty and conduct uneconomical for the purchase of used vehicles in favor of the mayor of Potosi.
